Terms of Service

Last updated 6 July 2026These Terms of Service ("Terms") govern your access to and use of Pointing (the "Service"). By using the Service, you agree to these Terms — if you don't agree, please don't use the Service.

1. Acceptance of these Terms

By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. The Service

Pointing is a planning-poker estimation tool. The core Service is free to use and does not require an account — you can create or join a room anonymously. Creating an account is optional and adds persistence features such as saved sessions, decks, and history.Donations are optional and never unlock a feature of the Service — the core product stays free regardless of whether you donate.A paid "Team" tier is planned for organizations that need advanced administration, roles, and enterprise features. It is not yet available. When it launches, these Terms and our pricing information will describe what it includes and what it costs.

3. Free, but not open source

Pointing is free to use, but it is not open-source software. No license, right, or permission to the Service's source code, object code, or underlying technology is granted to you by these Terms or by your use of the Service. All rights not expressly granted here are reserved.

4. Changes to the Service

We may add, modify, suspend, or discontinue any feature or functionality of the Service at any time, with or without notice, and without liability to you. We are not obligated to maintain, support, or continue offering any particular feature.

5. Pricing and fees

The Service is currently free, with an optional donation and a planned paid Team tier as described in §2. We reserve the right to introduce new fees, change existing pricing, or convert currently-free features into paid features at any time. Where reasonably practicable, we will give advance notice of material pricing changes affecting an active paid subscription before they take effect.

6. Acceptable use

You agree not to:
  • Use the Service for any unlawful purpose or in violation of any applicable law.
  • Attempt to gain unauthorized access to the Service, other accounts, or connected systems.
  • Interfere with or disrupt the integrity or performance of the Service (for example, automated abuse, denial-of-service, or scraping at scale).
  • Reverse-engineer, decompile, or attempt to derive the source code of the Service, except where applicable law permits it.
  • Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
  • Upload or transmit content that is unlawful, infringing, or harmful to others.

7. User content

You retain ownership of any content you submit to the Service (for example, backlog items, session names, or deck labels). By submitting content, you grant us a limited license to store, process, and display it solely to operate and provide the Service to you and the participants in your session.You are responsible for the content you submit and confirm you have the right to share it.

8. Anonymous use and accounts

Most of the Service can be used anonymously, without creating an account. If you choose to create an account, you are responsible for maintaining the confidentiality of your credentials and for all activity under your account.

9. Termination

You may stop using the Service, or delete your account, at any time from your account settings. We may suspend or terminate your access to the Service, in whole or in part, at any time, with or without cause or notice, including for a suspected violation of these Terms.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

11. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POINTING AND ITS OPERATORS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) 100 USD.

12. Indemnification

You agree to indemnify and hold harmless Pointing and its operators from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Governing law
